Hi I am with a radio station in CA, we held an event for our listeners that lasted 7 hours. We sold water and soda, other outside vendors sold beer and food.

We ran out of water about a 1/4 of the way into the concert and had to wait to get more. The employees as well as the listeners did not have water for about an hour. It was about 100 degrees and not much shade.

My question is what if some one had a heat stroke at that time? would we be held libable for their medical? (we had medics at the event)

Whether you would be liable for those attending the concert is really outside the employment law arena.

If an employee had suffered heat stroke, regardless of whether water was available or not, it would fall under WC.
