Canadian Law. A friend of mine was in a car accident 3 years ago. The car insured in her son's name and she was driving without a license. Now she has been subpoenaed to appear in court. She owns a small residence but other than that she has no assets. Could she lose her home? Can she transfer ownership of her home to a family member to protect her from losing it?

Why was she subpoenaed to court, because she caused injuries or property damage to someone who has sued her, or because of a criminal charge for driving without a license?

Other than helping to get that clarified, I can't really help you since I know nothing about Canadian civil or criminal law. I did find you this link to a site which claims to be the first and leading guide to Canadian legal resources on the Internet (http://www.gahtan.com/cdnlaw/).

Good luck. I hope the above information will help you out.

I have been sued in a car accident in the U.S. Can the other party take my home if that is the only asset i have?

Possibly- if there is a judgment against you, then that judgment could become a lien against the property owned in theory. But at this point, I am not sure you should panic since most times insurance covers settlements.
