I have an evaluation coming up soon. I have a few concerns. First off I am fighting for custody of my 6yo. I am a stay at home mom My lil one is enrolled in a private kindergarten when she is with me. I have her attending girl scouts. Plus we are members of our neighborhood church. I found out that her dad has a domestic violence conviction, is standing trial now for annoying or molesting a child under the age of 18, standing trial for contempt of court. Now his current wife has left him due to his abusive nature. Are these things that I can bring up to the evaluator? She has moved out of the house that they rent and I know he cannot afford the rent on his own. IF I have proof should I take that with me to this appointment? I'm still in shock that it has to come to this. I have never been in trouble with the law and I have never been abusive with my kids. I do what's right. The only thing that I dont do is listen to what my ex says because he thinks women are beneath him. Any suggestions would be greatly appreciated.

Have you filed an emergency petition for custody of the child? Since the wife is gone, grounds of that nature exist. I suggest that you talk with an attorney as to whether or not to bring up the ex's issues. I would say not to because the evaluation is to see if the home is suitable for the child. If the evaluator finds it is a suitable environment, that should help you win the emergency custody petition and get sole custody of the child with the father having supervised visitation or none given the nature of his criminal law troubles. I suggest that you pursue sole custody and maybe consider asking the father to terminate his parental rights if you think he might, and he might to get free of child support if you get sole custody of the child in the courts.
