Could he get arrested? Yes. In most of these cases, there is not really an outcry to prosecute these kinds of things unless the parents push the point, but in theory he could be arrested for something- be it statutory rape or lewd and lascivious conduct with a minor.

The age of consent in NC is 16. It is not about him being over 18, it is about you being under 16.

I am in pretty much the same situation, I am 19 and my gf is 15, her mom lets us kiss hold hands, cuddle, kiss, but no sex, my parents are freaking out because I am dating a girl under 18 and are scared of me going to jail. As stated earlier, the age of consent is 16, not 15.5. Her mother cannot sign a document saying it is okay, because nobody can give consent for their child to commit an unlawful act. If you have permission to date, then that is fine. There are no laws against DATING. But no sex, and keep the cuddling and kissing to a strict minimum until she is 16. Sexual contact is not limited to sexual intercourse. As you are 18, I'm pretty sure you can understand that without having it spelled out.

So what happens when she turns 16? I can't be prosecuted for having sex with her even though I am going to be 20?
