I work at a very small design firm in NYS, there are only 6 people
employed here. Can I still collect Disability while out on Maternity Leave or does the company need to have a certain number of employees to qualify? What does my employeer need to do to help me atttain disability while I'm out on maternity leave? What are the steps I need to ask him to take, and doess he legally have to take them? Any and all advice would be helpful.

Thank you

Your employer is required to have a disability insurance plan either purchased from a private insurer or through the state plan fund. Have there been any deductions from your pay for DI? The employer may deduct up to $.60/wk to offset the cost of providing the benefit. No deduction doesn't mean the employer doesn't have the plan, though, as they may choose not to make the deductions. Ask the owner.
