I currently work for a company which has less than 50 employees in San Francisco. I am expecting a baby in December, at which point I will have worked for the company for 9 months. I know that I am not entitled to FMLA. Am I entitled to any leave or any state or city benefits?

There are currently 40 employees. 37 in this office.

You are entitled to pregnancy disability leave for all the time that your doctor certifies you as disabled (in a normal pregnancy, this will be 2-4 weeks before your due date until 6 weeks after your baby is born). That time will be job-protected; they cannot disipline you in any way for taking it, and they have to return you to the same position, generally speaking. This time is paid through the CA State Disability Insurance (SDI).
If you chose to take another 6 weeks after that, you can get Paid Family Leave, which is also paid through SDI. This time is not job-protected; you could be fired for taking it.

thank you very much for this information. It is exactly what I was looking for. I was confused by the term disability as I didn't know that applied to a hopefully regular birth and post-natal care.

Personally, after a very normal pregnancy and birth, I sure as heck felt disabled for a least a month! I didn't want to get out of bed if I didn't have to - I just stayed curled up in a nice warm bed with a nice warm baby in my arms.
