Last year 2005 my domestic partners share of health benefits was suppost to be taxed however it was overlooked by my employer. Jan 2006 they started to deduct an amount THEY determined to be correct and have been taking this amount out,the check before last they decided to take a lump sum of more than 50% of my net wages and this should have satisfied the LOAN they say they gave me to cover the taxes from last year. The deduction now continues in excess of the amount to satisfy the 2006 benefit. What is my recourse is this a violation of the law? It is a garnishment to satisfy their mistake to put money back into their pot. It has left me unable to meet my financial obligations. Can this be legal to just take what they want and not give notice as well as they are reporting this on my paycheck as pto/vacation advance.I am beside myself not knowing what to do.

did you sign any type of authorization for them to withhold more money from your checks? you may want to actually get a consult with an attorney about their right to do what they did. although you should realize it is likely a double edged sword......leave it alone and have a financial shortage....chase it and the could conveniently find a reason to let you go...
