I need clarification on the following:
1) California W/C law re: $16,000 available for vocational re-training??
2) Can I attend vocational school while out on medical leave?
3) How long can my employer refuse to allow me back to work using medical restrictions as a reason?
I have been out on W/C TTD since 2/3/04. Doctors released me back to work in October. Went to work for one meeting. Following day I received a call from the W/C insurance company saying "........your employer is not willing to take you back with restrictions.....you will stay on W/C disbility....." I have inquired from my employer under what conditions I would be allowed back to work. I was never given an answer. Looks to me like they have no intention of taking me back but cannot terminate my employment while out on leave.
