I have an access and utility easement on my property. Live in Massachusetts.


The lot is subject to the Town's right "to constuct. inspect, repair, renew, replace, operate and forever maintain, water mains, storm sewers and other appurtenances thereto and to do all acts incidental thereto".

So the easement is subject to the rights vested in the Town related to the conveyance.

Is there a way I can fight to terminate the easement? Or at least put an termination date on it?

the answer to your question is no........well you could get rid of the easement if the municipality were interested in outright purchasing that portion or the entire parcel of property....

Usually, state laws give municipalities utility and sewer easements.

Sorry, what you describe is a typical easement - there is no way the town or county is going to terminate their easement and no way you can force them to so long as utility lines continue to run under a porition of your property.
