View Full Version : Am I being fired because I'm pregnant? Oregon Oregon

I have a bit of an unusual work situation. I work for two independent salespeople in a financial services office. Officially I work for them and not the company we are all with. I have worked there for over six years and am pregnant with my first child. Throughout my pregnancy I discussed what the work arrangements would be when I returned from maternity leave and everything seemed to be OK. I am planning to come back part time and that was fine. Now, just two weeks before my due date I have been told that one of my employers is going to drop me and I will only work for the other one which will drastically cut my pay when I return. Am I being fired by that employer because I am pregnant? Is it legal for them to do that to me?

It appears that one of the people whom you worked for needs someone more than just part time when you return. Do you subcontract? I couldn't understand when you said you work for two but through the company?? Sorry maybe just a little tired and stupid but i was trying to figure out if you would even qualify for fmla,but it doesnt sound like it since you said you just work for them and not the company they work for...with fmla you need to be employed with a company with so many workers (dont know the legal numbers but the senior members will and let you know). Who pays you,the two guys or the company itself?

Nothing in your posts suggests even slightly that the one employer dropped you for being pregnant. As Turbowray pointed out, it sounds as if the one employer needs someone full time. Since it is only two people you work for and then just you, FMLA doesn't come in to play. There needs to be 50 employees or more within a 75 mile radius. You don't have any recourse as nothing illegal has transpired.

thanks for the info reguarding fmla,i will try to remember that for future responses to fmla questions...glad someone here knows the law cuz im just learning lol! :D
