View Full Version : welfare report permission to go to oz with child

:roll: hi I know that there are several of us who are battling with Ex's
so that we can move to OZ.
It looks as though I will have to go to
court.
I have picked up a lot of useful information from various
forums.

I would like to know more about the court welfare officer's
report as this seems pivital to the decision if I can go. My solicitor
today did not give me a very clear idea and I want to have a really
stong case stating why we are going. I know my Ex well and he will use
every trick & slander to prevent us going.
SO
If you have been to
court and been involved with the court welfare officer and the report
can you tel me your experiance.any tips are gratefully recieved.
Also do
I use a solicitor or not. I hope that you can help. DollyX

Hi Dolly

Can't
offer any solid advice except I am going through same route. Have been
to court 3 times so far to establish where ex lives! Seems it's really
important to have his permission but doesn't seem to matter that he
hasn't been around for 10 years for financial and emotional
support!!!!!!!!!!!!!!!!!!!!!!!!!!! We are due to be interviewed by
cafcass shortly (have u done that bit yet?). Do you know which area
you wish to settle? Do you know about schooling and housing in those
areas? This is the sort of thing they want to hear, that you have
thought about it etc?

(PS And that';s only 1 ex to
contend with - got the other one as well!!!!!!!!!!!!! Have 6 kids (3
mine, 2 his and 1 together! None of the exes have contributed anything
(financial or emotional) in past 12 years!!!!!!!) And now can't go
anywhere until they agree!!!!!!!!!!!!!!!!!!!!!!!!!

I would hope you are using a solicitor who specialises in family law.
Cases like this can be complex, and it's better to use a solicitor who
deals with this area day in, day out rather than one with a more general
focus.

Sorry to get comfort from your situation...but i'm in it too!!
Saw my
solicitor for the first time last week. Says we will need a cafcass
report as my son is 14 from my previous marriage. My son sees his father
every other weekend (or there abouts!??!!when its convenient on his
part) and he has always piad maintenance. This all seems to be besides
the point, as my solicitor (who deals solely with family law, and has
represented cases for both sides in these sorts of issues) claims that
husbands have to put up really good arguements as to why you cannot take
them with you, especially if they have always lived with you!
Basically,
they have to claim that their life with you will be worse than a life
with them, and that you have not thought about going properly, and are
merely going on a whim..........just shows...if ex's knew the
immigration process, they would know that we wouldn't go through it on a
whim!!!!
the solicitor recommended finding out about schooling, housing,
jobs, recreational activities, etc etc. you don't actually have to
justify why you are going, but that you will provide a stable and loving
environment for your child once they get there, based on the possible
impact of moving.
I would advise some legal representation, and my
solicitor has advised a barrister for the final hearing....as my ex is a
bit of a 'i'm going to destroy you' type of person!!
