View Full Version : Busted him working under the table, can I get C.S.?

My ex and I are headed back to C.S. court (New York). He was unemployed back in July of 2003, and had our order reduced to $25/week, to return to previous amount when he gains employment. Through the web, I have found out that he has had several jobs since. (He is a D.J. and a wanna-be musician and can't help but brag about all the gigs he has been doing.) The judge asked him to present to the court any dates of employment he has had since July of 2003 so they can adjust his arrears to the first date of work. While i was searching his name, I found blogs and message board entries that he had posted where he states he is working as a D.J., gives address, employer name and times, as a reference for a job post on a board. My fiance called the employer, and the employer states that he had worked there for over a year and a half (during the time he stated he was unemployed.) He did not report this income to the IRS, as it is not in his tax return he filed with the court. Am I entitled to c.s. from this unclaimed income? Also, what proof is needed in court to prove that someone was working under the table?

You will probably be able to get CS for the 1 1/2 yrs that he's been employed, you can subpoena his employer's records to prove that employment. Unfortunately the blogs and message boards posts aren't enough proof of employment, so you'll probably only get retroactive CS for the amount of time that you can prove thru employer's records.

Proving that a person is working under the table is very difficult, but not impossible. About the only way to get proof is if you can find whoever is paying him and get them to testify in court as to how much NCP earned from them.
