View Full Version : Fired can they do that? Need Help please

Hello,

I have a friend who has worked for a factory in Tenn. for several years, and had a good employment record, however, recently he was recently Fired from his job for leaving to attend to his mother who was in a nursing home, and who has recently passed away. His mother called him at work and told him that she couldn't breath and asked him to call the rescue team, the gentlemen called and sent the rescue team (ambulance) to the home to pick up his mother, and he also left work to go meet her at the hospital. She had been sick, and they didn't know how long she would make it. This happened a handful of times, and just one week before she passed, they fired him for it. Is there anything that he can do? He is a hard worker, and had a real good work record until his mother got this medical condition. Any suggestions? He's losing his house and car now because he isn't able to find employment, and there are remaining hospital bills that he is paying on.

It's possible that this situation of him having to care for his mother could be FMLA-qualifying.

1. Does the employer have at least 50 employees at his job site or within a 75-mile radius of his job site?

2. Did he work there at least 12 months?

3. Had he worked at least 1,250 hours in the last year?

4. Did he have any other time off related to his mother's medical condition in the past year?
