Our caregiver facility pays staff double pay on holidays when they work. We have 24/7 staff on duty and when a staff member is required to sleep down from 9PM to 6AM the following morning;
1. Can we pay only the 3 hours from 9PM to midnight of the holiday the double pay rate?
2. Or are we expected to pay double holiday pay from 9PM to 6AM the following day?
3. Can the board set the hours for holiday pay? :confused:

Neither Federal nor Arizona law requires that you pay any kind of premium pay for working on a holiday. It is entirely up to you whether to do so; what kind of a premium (time and a half, double, etc.) and under what circumstances.

Yes, you can. The only legal requirement in your state is that you pay time-and-a-half for all hours worked in excess of 40 in a work week. As long as you are paying at least that, you're in compliance.

Not only can you choose the hours for double pay, you can choose NOT to pay double pay at all.
