You should check your company's policy regarding unused vacation to see if you are entitled to payment. Typically, if you have accrued but unused vacation time, you will be paid for those hours at the time of termination. However, you would not be paid for any hours that you have not yet accrued.

At my job you either take your vacation or you lose it. they don't pay you.

Florida law does not address the payout of vacation at termination at all. IF the company policy is to pay it out and IF such a policy is in the employee handbook and IF it rises to the level of an enforceable contract (which it rarely does), THEN you MIGHT have a civil suit if it is not paid.

What has been the practice in the past? Have other employees who have terminated received a vacation payout? All of them? Some of them?
