I have custody of one of my daughters, my ex has the youngest. I was told to pay close to $800 a month child support. I find out after mediation, that I am paying an amount from the Child Support Guidelines Worksheet, that this amount is for two children. Now I'm told, I have to file a Supplemental Petition to Modify Child Support and pay another $2,500 to go to court. We were divorced in Dec. 2005. The statutes mention some leverage for "errors", but was told that it has to be an error on the part of the judge. Well, what about an incompetent attorney? Why do I have to pay to get this corrected? Anyone have any experience with this? Thanks, I'm tired of getting the shaft!

It shouldn't cost that much to modify. Is the amount you were told for court costs or was it for an attorney?

It sounds like a pretty easy case, so you do not need an attorney to file. Go to your court clerk to find the forms to file to modify the CS order, then when you go to court all you'll have to do is show the Judge the current custody order and the CS will be modified to only one child. The only thing you might have to pay is the filing fee, but that is usually less than $300.
