I live in a subdivision with a 30' row used by all 16 homeowners. The row was built up over a stream. It is now collapsing and we want to repair it. However the person owning the property next to the row says we can't go onto his land to do repairs. Because the damaged area is mostly on that side of the road we need to use his land to do repairs. If this row collapses all 16 homeowners will have no access to and from their homes. Can this property owner keep us from doing repairs? I would appreciate any information concerning this issue.

I suggest going to court and getting a court order to do the repairs over the objections of the property owner; also, if an emergency situation you all can probably do the repairs anyway, but it is safer with a court order. You all may want to consult a local attorney but I think you all would be ok doing this on your own too.
