I'm kind of lost in the post. All you want to do is change her last name? And I don't mean to be rude or judgemental, but WHY is your four year old worried about this? Anywho, according to the information on this link, you can.

If the mother agrees to change the BC and name the link will help. However, if the mother does not agree, you'll have to file a motion with the court to change the name and BC. It's usually an easy procedure and the court almost always agrees to the changes. Check with your court clerk to find the forms for name change.

Even if they will not allow a complete name change, he most assuredly will be able to ADD his name to the child's name (ex: Smith - Jones) :)
