I was wondering if the father does not show up for court, how do they order child support? How will they know how much he is making?

Thanks for any help. They will subpoena his past tax returns (usually the past 3 years) to determine what his income is. He didnt show for either one. Now we have to go to court. He has said both that he will not go and that he will go and also file for custody. And he has also said that he will sue me for waiting so long to tell him. I am not sure if you read my other post or not but I gave much more detail in that one. I was also wondering if they will set the back child support up for payments or if they will have him pay all at one time. Thanks for the help. One if he doesn't show for court, he will be considered the father by default. i didnt' read your other post, but will in a few. HE can file for custody all he wants. It doesn't mean he will get it. He would have to prove that you are the worst crackhead on earth to get full custody.He may be able to get visitation, but you can request it to be supervised in the beginning if you feel your child's safety may be at risk. mom2him 05-22-2006, 05:34 PM I really want him to have visitation. Usually retroactive CS will go back to the date of filing and the NCP is usually ordered to make exta payments instead of a lump sum. Under the circumstances, the court may not order any retro because the father was unaware of child for 11 yrs. This doesn't happen often, but it can happen and you should be prepared for that possibility. |
