I just went to court friday to start custody and visitation rights. My attorney informed me that her attorney is saying i have to pay for her attornys fees? Can this really happen? It really seems the guys are behind the 8 ball in any custody case . can someone please answer ? thanks

The standard practice as I understand it, if you file the complaint/change/custody appeal, that person filing is responsible for the legal/court fees unless you ask the court for and granted re-imburshment by the other party for the fees.

Just because she asks for fee's doesn't mean she will get them. It has a lot to do with the outcome of the case. If your grounds for seeking whatever it is you are going to court for is determined to be frivolous, you may have to pay, but if your case is substantiated (reasonable) then I doubt you would have to pay any of her fee's. Whether or not you have to pay her fee's would be determined by the judge, not her attorney.

Also, you do not have to pay any of her fees until a Judge orders you to. :)
