I live in the state of Wyoming. I was terminated from my job just 8 days shy of 3 months on the job. My former employer tried to change my date of termination to collect 2 months of COBRA, even though the insurance plan states that any employee terminated at any time during the month is covered until the last day of that month. She has left me a message to the effect that I either owed her 8 paid sick days or 2 months of COBRA. She is now sitting on my COBRA payment for September, until she receives either the sick pay or the 2nd month of COBRA. I need to know if she can do this, I fear that I will not have the insurance coverage I need.

You are correct that you if you are terminated any time during the month, then you are covered until the last day of that month. In addition, you have 60 days to make a Notice of Election to continue coverage under COBRA. Your employer cannot discontinue your insurance coverage until that 60-day period has passed with no election and/or premiums paid. It sounds like you have already made an election and have paid a premium for at least one month.

What was your last day of employment? What does your September COBRA payment cover? How long are you planning to continue COBRA?
