I was wanting to know what can be done by cs or if I will need an attorney in regards to cs. Bio mom never been court ordered to pay. Been over 7 yrs since custody set. She is currently incarcerated and cs office says that they cannot set anything while she is incarcerated. But according to an attorney, they can set it based on the minimum or on her education along with job qualifications(on average earning potential) if not in jail. And that we can request for retro and go back to the time that custody was given to my husband? Is this true and what do we need to do?
What state are you in? Some states allow for filing for CS while NCP is incarcerated while some don't.
