I hope you can answer this for me. I just found out today, that the retail store I manage is going out of business in 4 wks. As of April 1st, I am entitled to 2 weeks of vacation time. If I work til the store closes, without taking the vacation time, am I entitled to those weeks in wages? My store is located in RI, but the main office is out of New York if this matters. Thank you for any help

Did you accrue those 2 weeks in the past? Or would you have accrued 2 weeks if you worked to April, 2007?

Hi Patty, I just had my 2 year anniversary in April, and I was eligible for the 2 weeks since that date. In other words, I could take the weeks now, if not for the store suddenly closing. In fact, I will take the weeks off if I can't get the 2 weeks as wages. I hope I am explaining this ok. Thank You

Yes, RI law provides that earned, untaken vacation be paid at termination if the employee has been employed for at least one year.

However, you only need to be paid what time is actually accrued on your last day of work, not what would have been accrued had your employment continued.

OK, I'm not sure how my time is accured. I know as of right now, I could take my 2 weeks, so I'm assuming they just give me the two weeks on my anniversary date. If I'm wrong, they will probably only pay me a fraction of it. At least I will be entitled to some of it. What about sick time? At the moment, I have 40 hours of sick time, what happens to that?

No, they are not required to pay out sick time.
