related to cardiac problems and strokes. However, many advocates of Ephedra
maintain that it is safe when used as directed, and continue to regard it as
a dietary supplement rather than as a drug. Health food store GNC banned
ephedra-containing products in June 2003, and the National Football League
banned players from using it as a dietary supplement in 2001. Ephedrine is
considered a performance-enhancing drug and is prohibited in most
competitive athletics."

So far, ephedra is not classified as a drug but as a food supplement. I
believe the difference would be that for the FDA to ban ephedra (as a food)
they themselves must establish harm, which can be tricky. If its a drug,
then the manufacturer must establish safety, the opposite side of the same
coin!
The FDA accepts a certain amount of possible harm in the risk/benefit
category. Hey! Even people who go in for wisdom tooth removal occasionally
do not wake up!
My wife successfully used Stacker 3, an ephedra based weight loss drug in 2003 to lose over 175lbs. Her sister lost 60lbs. using the same supplement. Both experienced no problems. The package explicitly stated that persons with heart problems, liver problems, high blood pressure and history of other related medical problems should not use this product.
Thousands die every year from complications of diabetes from consuming too much sugar. Should we ban sugar? Alcohol related injuries and deaths certainly have not brought on a ban of alcohol. Of the 155 documented ephedra related deaths, how many of those 155 were not supposed to be taking it because they were at increased risk of heart attack or stroke?
