Hi, I have worked at the same factory for 2 and half yrs. We have been through 3 supervisors in that time, now they just are not hiring one, they have given the duties to another team leader who has been there for 15 yr. , which in my opinion and cant understand why he doesn't like me due to the different treatment he gives me,,,lots of examples: I got yelled at because for the first time in 2 yr i forgot to take off my watch at work,which about i'd say 65% of employees wear them and rings,,, and I got yelled at because I have waist legnth hair,,, i had it in a pony tail one day before 7 a.m. (which is work time) but I didnt have the bottom flipped up and tucked in yet,,, which 3 other girls never have thier long hair all the way up, is always hanging. another is when I transferred to touch-up dept. he always made me work overtime even if i didnt have anything to do,, i would have to walk around and look busy when the owner came by. He makes out a preliminary overtime Saturday list sometime when needed,,maybe 15 workers out of 50 in that dept. I have been on every single list, I asked why and he says cause I missed days, which another girl missed 3 days that week and she has never been on any list since she has been there in 8 months. along with many others who have never been on the list, (who has taken off days) I have asked many times for a raise,,,,, there are people who have only been there 3 months doing the same job making more than me,,,, I have been cross-trained and can do just about anything in the finishing dept. I work very hard,, i get along with everyone in the whole plant, they all know and will vouche that I work very hard. He and others have also made fun of me for months cause I am so skinny,, I laughed with them, maybe I shouldn't have but I tried so hard not to get on his bad side hoping he would quit (picking) on me,,,, which is how I see it. I have cried many nights and lost alot of sleep over everything he does to me. He won't give me a raise and yesterday we got out Christmas bonus which everyone that has been there about same time i have or less got 300.00 more than me. I don't know what to do, I got another job and start the 6 of Dec. I hate not doing anything cause of the way he made me feel,, also I talked to 2 other girls that say he used to "pick" on them for a while too but let up after couple months, which they would never say anything afraid of getting on his bad side. What can I do to keep him from doing this to anyone else and would I have a legal case with any of this? In Kentuck,,,,,,, thank you and please help........

Do you believe that you were singled out because of your age (over 40), disability, national origin, pregnancy, race, gender, sexual harassment or religion or because he is retaliating against you because you may have filed a workers' compensation claim, a safety violation or something like that?
If the treatment you are receiving isn't because of discrimination or retaliation, it probably isn't illegal. You can talk with the supervisor's manager or to the Human Resources Department (if there is one). However, if they don't take action at that point, you need to take the action you have already decided to...go to another job and leave the other behind.

I just want to know if I can take legal action against a senior t/l. Here's my story, I work for a department that monitors each team. What we do is make sure that agents are adhering to their scheduled break and not abusing company's time. This Sr. T/L from different dept approached me and asked me as to why his team was on the list, I explained and told him what had happened (what his agents did). Then after that he came back yelling at me and complaining that I have to let him do his job and accused me of things that I didn't do. There was no discrimination, no sexual harrassment but he just went out of control and yelled at me. Please let me know if there's anything that I can do legally to have him reprimanded. :rolleyes:

Unfortunately, no. Not all harassment is illegal. If it isn't due to the reasons I described in the earlier post, it is just poor management. If you are under a Collective Bargaining Agreement (union), you can complain to the shop steward. However, a union is no guarantee that the situation will be handled to your satisfaction.
If you and several others complain about him to more senior management AND he then retaliates against you and the others, the employer could find itself in violation of the National Labor Relations Act, even if you aren't represented by a union. That is because a group of employees negotiating an issue, complaining about a poor supervisor, etc., could be viewed as a concerted activity...you are acting as a "quasi" union. That doesn't mean that the management would have to make changes or reprimand the supervisor. It just means that they cannot retailiate against you for raising the issue. Raising the issue with more senior management may work in your favor...often, it is not so much that senior management condones poor management skill. Instead, they are just not aware of it.

Hi, me again from factory in kentucky,,, just letting u know what happened when I put my 2 week notice in,,,,,,,,they fired me the next day,,, said they wer'e not firing you, only accepting your resignation,,, i asked why they firing me,,, they said they are not firing me,,, I said I am not quitting today,,, not for 2 weeks so let me go back to work,,,, they kept repeating they are not firing me but would not let me go back or would not give me any reason at all.

Letting someone go before their stated date of resignation is firing a person. Even if the person gives notice of a resignation, he/she hasn't left yet. The employer is issuing a preemptive strike. If you feel that this came about because of your complaints, it could be a violation of the National Labor Relations Act. You and your coworkers have the right to talk with an employer about a term and condition of the job. If the employer takes punitive action against you, such as firing you, it could be seen as a violation of that right.
While you may not wish to pursue this because you now have another job, keep it in mind in case you want to take action. Let me know if you have any other questions.
