View Full Version : Losing everything to employers bankruptcy!

In 9/01 a former employer talked me into moving back to Florida to run his 830 acre ranch. So I sold my mobile home and me and my fiance moved to Florida on his ranch.

A contract was drawn up and in it we were given approx. 30 acres and a barn for us to be able to start raising and selling horses. Well that never developed.

In 1/02 we had gone to Alabama to pick up some things we had left and when we get home we get a phone call from one of the company salesmen. He told us our boss had filed for bankruptcy and our last checks were NO GOOD!! Sure enough after checking with our bank they had bounced!

Things started going crazy. We were asked by the trustee to stay on and watch out for the ranch. We did just that. We never recieved any pay for it and before we left the ranch (which by the way was owned by his 40 yr. old business) in July we had sold most of what we owned just to survive. The trustee lied (verbally) about us being paid. We filed everything with the court like we were told to do and she fought us tooth and nail.

The bankruptcy was over the end of 05. We never were paid for the 6 months we stayed on.

I was just wondering if there was something we could have done then. The trustee blocked us every way she could and won every time.

We came to the place we are now in July 02 and finally got back on our feet. That was the hardest thing to go through and so unfair.

Our employer even sent a letter telling the trustee we needed to be paid. No go! They liquidated everything he owned. Was there any money left for him?

Get it in writing from a trustee- they operate in the best interest of the bankruptcy, not for the debtor and the debtor's employees. All you can do is file a claim for unpaid wages, but if the trustee puts creditors ahead of you all you could really do is contest this and ask to go before the bankruptcy court judge with your contest. It sounds like you have moved on, so maybe be glad you could. It does not sound like there is any money left for anyone to recover at this point.
