My husband works as a truck driver for a rock, sand & gravel company. Recently he found out that due to the rise in fuel prices, the company was planning on withholding fuel costs from the driver's paychecks. My husband does not own or lease the truck he drives, the company owns the truck; we would like to know if this is legal for them to deduct this from his pay. The company is based in Oklahoma and hauls loads as far south as Dallas, Texas. If I am understanding 380:30-1-7 Work Without Pay & Deductions section of the Oklahoma Department of Labor Wage Law Administrative Rules, this is not legal. However, we wanted to make sure.

I can't find that law or any reference to it on the OK DOL website. Can you post a link to it? Thanks.

FWIW, in my humble opinion, that's a dumb policy. It's like it's the employee's fault fuel prices have risen dramatically. Sheesh. :rolleyes:

Thanks. After reviewing the law, I agree with you that such a deduction would be for an unlawful reason, so even if there was a written agreement, authorized by the employee. the deduction would be a violation of this regulation.

Have they tried to get him to sign anything yet? Deducted anything yet?

Deducted anything yet? - And, yes they have been deducting since he started approx 2-3 months ago. We just found out in the last 2-3 weeks that this was being done.

If for some reason he decides to quit - would he be able to request reimbursement for these deductions?
