I HAVE BEEN TRYING TO GET MY EMPLOYER TO PAY ME OT. I AM HOURLY IN TEXAS . HE HAS BEEN PUTTING ME OFF BY SAYING HE NEEDS A COPY OF THE NEW LAW(WHICH I HAVE PROVIDED). AND NOW HE IS CONSULTING WITH A LAWYER WHO TOLD HIM THAT THERE ARE SOME NEW CHANGES TO THE OT LAW. IS THAT TRUE AND WHERE CAN I GET A COPY

The changes to the overtime rules dealt mostly with the factors determining if someone is eligible for overtime. I will give you a link to the DOL website which explains exemption. However, it can still be quite confusing. So, please feel free to ask additional questions. Also, several states have additional rules regarding overtime. So, if you want state specific information, please let me know where you live.

Unfortunately, Texas is not one of the states that provides additional overtime benefits. You can read more about Texas' regulations at: http://www.twc.state.tx.us/customers/jsemp/jsempsub7.html

I Looked At That Site And It Does Not Address Overtime In Texas. It Sends Me To The Dol Site. I Thought That Since Texas Does Not Have Ot Provisions That It Went By The Federal Laws. As I Mentioned Before My Employer Is Trying To Get Out Of Paying Me And Others Ot. I Know The New Law Went Into Effect 8/23/04 But Today He Said That The Lawyer He Is Consulting With Said Some New Regulations Came Out Today. I Cannot Find Any Such Regulations.

I know of no overtime laws in Texas that were released today. I live in Texas.
I think if you do not have written cause by end of week, you have good cause to begin filing for overtime due you. I cannot of course advise you on what to do, but please proceed in your best interest.
