I am a small business owner and I was told that if I had 4 employees or less, I did not have to pay overtime. Is that true?

Also, I have 6 employees now, and pay overtime after 45 hours, but they get paid for their 1 hour lunch, is that ok?

There is no such thing as if you have less than 4 employees, you do not pay overtime. Some of the companies based on turnover only are exempted.

About not paying overtime for the lunch time, labor law requires you to pay for the time spent on premises or as a part of duty. The lunch break is not considered as not being part of duty. So you have to pay for the overtime beyond 40 hours per week including the lunch time.
