I recently decided to refinance our home and in the process recieved a
call from the title companany stating there was a problem. There was a
lien placed against our house. As it turns out the lien is for some
one with my same name just a different middle initial. The lien was
put on our house by a major bank for non payment of a credit card
bill. I HAVE NEVER HAD ANY TRANSACTIONS WITH THIS BANK. I have
contacted this bank trying to get them to correct the error. The first
time they said they would not remove the lien unti we paid the bill!
Duh, I tried again and they will still not admit thier mistake, they
want me to sign all kinds of affidavits that I am not the person that
they filed the original judgement against. The are acting as if I am
trying to get out of paying the bill and having the lien removed. I am
so frustrated, It is thier error, they are the ones who did not do the
proper reserch when the decided to put the lien on my house. I have
never considered filing suit against anyone before but I am being told
that I should just turn the whole thing over to a good attorney butI
can't afford to pay one. Any comments/suggestions?

Most definitely. And it shouldn't cost much - all he needs to
do is write a "polite" letter detailing the problem and consequences
and the bank will fix it immediately. He should also suggest
reasonable compensation for your expenses and trouble. If they
don't compensate you - take them to small claims court after you
refinance.
It's simply a matter of reciting the "magic words" - as soon as the
bank hears them it'll fix the problem.
Many years ago I had a problem with Chase - they kept screwing up my auto
loan payments. Phone calls did no good - they kept screwing up. My lawyer
gave me the "magic words" ("unfair and deceptive trade practices") and
I wrote a letter to the CEO of Chase. Bingo! A week later I got
a phone call from TWO account specialists - people who knew the system.
I told what was happening - they pounded on the their boards for a while
and talk among themselves and figured out what was going on. A few months
later I got a phone call from a VP asking if everything was OK.
About 6 months later they switched to a new computer system and things
got screwed up again (They reported each loan twice to the credit bureaus).
I just paid off the loans and swore I'd never deal with them again.
