I am trying to find out exactly what the labor laws are in Kentucky about pay scale adjustments. I have taken a new position in the company that is at a higher pay scale, but the company has yet given me my raise to that level after 3 months of continued questions on the subject. They keep telling me that there is a pay freeze at this time and they don't know when they will get to change my pay level. To me this really sounds funny from a point of view that if I hadn't taken the position, they would have had to hire someone and start them out at the pay scale level that is appropriate for the job at hand. I also want to know what is the law on the back pay that I haven't received over the 3 months of doing the job already.

Any help would be appreciated because I am so frustrated with this company over this issue.

There isn't a law such as you are describing. Absent a law, it means that the employer can make or not make adjustments to pay. The only restrictions are when the employer is treating someone differently for discriminatory reasons, such as age, race, religion, disability, national origin or gender OR in retaliation against a person for protecting their legal rights, such as complaining about discrimination, filing a wage claim, filing a workers compensation claim, etc.

Do you believe that such a situation exists?
