View Full Version : After Chap 7 in GEORGIA/What do I do???

My chapter 7 was discharged in December 2003. I surrendered my 95 Galant. 13 months later the creditor came for the vehicle. They came to my job and did not contact my attorney for the vehicle whereabouts. The vehicle had brokedown in Oklahoma where my mother lives and had been in the shop for 6 months (did not have money to pay for repairs). The creditor contact the repair man and advised that the bill was $3,000.00. They explained that they would not be coming to get the car and the repair guy can apply for a lost title. 6 months later my mother drives to GEORGIA IN THE CAR.She/Mom explains that her and the repair guy made arrangements and he has the title. The tags had expired on the car so I went to the tag agency to check on them and the tags were still in my name and a lien was still held by the creditor. My mom contacted the guy and he said he was still working on the title. Now the car has brokendown for 6 months and it is at my house. The repair guy has closed his shop and we do not know where he is. I want to call the creditor and have them to come and get the vehicle, but I feel as if they will retaliate against me. I have another car that is paid in full and have rebuilt my credit, bought a home. But this car/Bankruptcy is still following me.

Well sounds like you need to track down the repair guy to see if he ever got a lost title because the company seems to have written this off already, and trying to give them the car may open Pandora's box for you. I suggest consulting with your bankruptcy attorney also about what to do.
