I work for an agency that normally does not have paid overtime. However, in August we we approved to have paid overtime. We worked in August, September, October & now November and with promises that we would be paid soon. Each month " Well maybe at that middle of the month, or At the end of the month." Last month we were sent an email telling us that we would be paid on the 15th of this month. Lo and behold this time we were told that "there was an error paperwork was lost that we will be paid maybe on or around Dec. 1st. Is there any laws that protect us from not being paid our overtime? And what time lines do the employers have to pay the overtime if any??? :confused:

I have worked at a construction company for 1 year and 6 months.
The employer agreed to be a sponsor for me to have a green card.
I recieved $3000.00 per month. I am a licence architect and have 15 years experience including 6 years in the USA.
He told me he can not give me more money and no overtime and because he sponsor me I have to work overtime and not paid.
I have wored some times 12 hours a day, 70 hour a week and even Labor day holiday.
The employor and I had some miscommunication and he yelled me a lot infront of a lot of employees that was not my fault.
I screemed him "Stop yelling me!" and run out the company because I could not hold my temper more at that time.
He called me and said "You fire. we no longer sponsor you! Go to your country".
I was so upset and repused to recieved the final check and called the lawyer to process my case. He recommended me to go to your office again and talked the employer to keep my case.
I received the check by mail. I have talked the boss again and told hime please keep the case it is nothing for them. He did not confirm at that time and told me when the labor department approves my case, talk about wheather keep going or not.
That is the sole reason I did not file against him. The time passed 2 years and the Labor Department sent letter to my Lawyer and the boss wheather my case should go or not. And unfortunately he just returned the letter signed "No".
I am going to file against him and his company not paid overtime. I have a note that I have wrritten all of my working hours.
What do I have to do? Just go to the Labor department or go and see the labor lawyer? :mad:
